These Terms and Conditions ("Terms") govern access to and use of Plant Closing Report, including the website located at plantclosing.report (the "Site") and the subscription report service (the "Service"), provided by Midwest Consulting Alliance LLC ("Company," "we," "us," or "our"). By accessing the Site or subscribing to the Service, you ("Subscriber," "you") agree to be bound by these Terms. If you do not agree, do not use the Site or Service.
Plant Closing Report is a subscription-based newsletter delivered every other Monday, identifying newly announced industrial plant closures across the United States along with contact information for relevant decision-makers. Report content, format, and delivery frequency may be updated from time to time at our discretion.
The Service is offered under paid subscription plans as described on our Pricing page, including a Monthly plan and a 6 Months+ plan. By subscribing, you authorize us (and our payment processor) to charge your payment method on a recurring basis at the rate and interval applicable to your selected plan, until cancelled.
All payments are processed by a third-party payment processor (Stripe). We do not store your full payment card details. Prices are subject to change with reasonable notice for future billing periods.
You may cancel your subscription at any time by contacting us at info@plantclosing.report or through your account settings by logging in to website.
Reports are compiled from publicly available and manually researched sources believed to be reliable at the time of publication. We do not guarantee the accuracy, completeness, or timeliness of any information contained in a report, including company, facility, or contact details, which may change after publication. The Service is provided for informational purposes only and does not constitute business, financial, investment, or legal advice. You are solely responsible for independently verifying any information before acting on it.
Reports and the contact information they contain are licensed for your organization's internal business use only. Unless we agree otherwise in writing, you may not resell, redistribute, publish, or share report content or contact data with third parties outside your organization, or use it to send unsolicited bulk communications in violation of applicable law. You agree not to misuse the Site, attempt unauthorized access to our systems, or interfere with the Service's normal operation.
The Site, the Service, and all reports, compilations, text, graphics, logos, and other content we provide are owned by or licensed to Midwest Consulting Alliance LLC and are protected by copyright and other intellectual property laws. Subscribing to the Service grants you a limited, non-exclusive, non-transferable license to use report content as permitted under the Acceptable Use section above; it does not transfer ownership of any content to you.
To the fullest extent permitted by law, Midwest Consulting Alliance LLC and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or business opportunity, arising out of or related to your use of the Site or Service, even if advised of the possibility of such damages. Our total liability for any claim arising out of these Terms or the Service will not exceed the amount you paid us in the twelve (12) months preceding the claim.
We may suspend or terminate your access to the Service at any time for violation of these Terms, non-payment, or other conduct we reasonably believe is harmful to us, other subscribers, or third parties.
We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date above. Continued use of the Site or Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Kansas, without regard to its conflict of law principles, and any disputes arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Kansas.
